Petsitting Service Contract                        Date:

- For the purposes of this document, the terms Client, Owner, Pet Owner, and Customer are synonymous with the person contracting services for one or more domestic animals. 
-The petsitter, Backyards to Barnyards, is not responsible for wilted, dead or otherwise unhealthy plants.  The Pet Sitter will work hard to follow your written directions as precisely as possible, but cannot be responsible if the results are not favorable.  Please place all indoor plants together on a waterproof surface in plain sight, as your pet sitter is not responsible for water damaged areas or missed plants.
-The petsitter, Backyards to Barnyards, is not responsible for damage to the home beyond the control of the Pet Sitter.  This includes, but is not limited to leaks, electrical problems, and acts of nature.  In these situations, the client will be attempted to be contacted, and then the emergency contact before making a subjective decision on dealing with the problem.  All repairs and related fees (including Special Service emergency service time and coordination fees) will be paid by the client, or fully reimbursed to the Pet Sitter within 10 days. 
-There is a 50% non-refundable deposit required for all services provided to hold dates. Service will not be scheduled until deposit is paid. Remaining balance is due within 5 days of invoice sent. All accounts not paid within 10 days after the date of sent invoice may be subject to a $25 late fee. Unpaid balances are subject to 1% interest at the end of every month. Client will also incur any fees that result from an unpaid balance (collections, certified letters, etc)
-The petsitter, Backyards to Barnyards, is not responsible for any damage to property of the client or others unless such damage is caused by the negligent act of the Pet Sitter.  Backyards to Barnyards agrees to remain insured through PSA or a comparable pet sitting liability insurance entity during each service period.  The Pet Sitter accepts no responsibility for pet care, loss to the premises, or damages if other individuals have access to a client’s home or if the home is not properly secured.
-The petsitter, Backyards to Barnyards, is not liable for any loss or damage in the event a burglary or other crime that should occur while under this contract.  Pet Owner agrees to secure home prior to leaving the premises.  The Pet Sitter will attempt to re-secure the home to client instructions at the end of each visit.  While keys are in the possession of a Pet Sitter, they will be either on the Sitter’s physical person, or be properly secured.  
-Pet Owner must have legal rights to place the animals in the care of Pet Sitters, Kennels, and Veterinary Clinics.  The Pet Sitter cannot service a home with “Visiting” pets or animals that do not belong to the resident of the service site without separate sets of agreement forms, including a Legal Considerations Agreement, accepted and signed by each rightful owner(s).  
-The terms of this document apply to all the pets owned by the client, including any and all new pets that the customer obtains on or after the date this document was signed, at any and all locations the owner designates for service.
Pet Owner is responsible for pet-proofing house and yard, and the security fences/gates/latches. If client requests or allows animals to be free reign, off leash, at home or in any location where service is being provided, the petsitter, Backyards to barnyards, accepts NO liability. The petsitter, Backyards to Barnyards, will not be responsible for the safety of any pets and will also not be liable for the death, injury, disappearance, or legal consequences of any pet with unsupervised access to the outdoors.

-Client MUST initial here if your dogs are allowed off leash on the property.  Backyards to Barnyards is not to be held liable for anything that may happen as a result, nor will insurance cover the cost of anything that happens as a result. 


-The petsitter, Backyards to Barnyards, is authorized to seek any emergency veterinarian assistance needed during visits, at the cost of the client, from any veterinarian as chosen by the sitter. Moreover, the company is not responsible for the health/well being of the animal.
-Pet Owner is responsible for supplying the necessary, safe equipment/supplies needed for care of their pet(s), including but not limited to a sturdy, well-fit harness (halter, collar, etc…) for walks or in case of emergencies, firmly affixed vaccination tags, a lead rope or leash, pooper-scoopers, litter boxes, food, cleaning supplies, medicines, pet food, and cat litter.  Pet Owner authorizes any purchases necessary for the satisfactory performance of duties.  Pet Owner agrees to be responsible for the payment of such items, as well as service fees for obtaining items, and will reimburse the petsitter, Backyards to Barnyards,within 10 days for all purchases made.
-Pet Owner will be responsible for all medical expenses and damages resulting from an injury to a Pet Sitter, or other persons, by the Pet(s).  Customer agrees to indemnify, hold harmless, and defend the petsitter, Backyards to Barnyards, in the event of a claim by any person injured by the Pet.
-It is suggested that arrangements be made with someone to evacuate your pets in case of a disaster or weather related event/crisis/”Code Red”.  The petsitter, Backyards to Barnyards, will definitely try to see to your pets safety/care should such events occur, but cannot guarantee service. In the event of inclement weather, pets with life sustaining medications will be visited first, then dogs, then cats. ALL clients must maintain up to date information for alternative back up care for every sit.
-This contract permits the petsitter, Backyards to Barnyards, to accept all future telephone, online, mail, text message, or email reservations and provide service without additional signed legal considerations agreements.  
-Backyards to Barnyards retains the right to use any pet photographs taken during service for in and all of it's publications including but not limited to all Backyards to Barnyards print and digital publications. I understand any and all pet photographs taken by Backyards to Barnyards staff is property of Backyards to Barnyards and the pet owner will receive no financial compensation. I hereby irrevocably authorize Backyards to Barnyards to edit, alter, copy, exhibit, publish, or distribute photographs for purposes of publicizing Backyards to Barnyards programs or for any other related, lawful purpose.
-The petsitter, Backyards to Barnyards, may use their discretion to stop and end service at any time that a pet poses a danger to the safety or health of itself, other pets, other people, or the Pet Sitter. If concerns prevent the Pet Sitter from continuing for a pet, the Owner authorizes the pet to be placed in a kennel, or previously arranged locale if possible.   All subsequent charges, including but not limited to transportation, kenneling, tranquilizing, treating, accessing, and liability, are to be the responsibility of the Owner. 
-The petsitter, Backyards to Barnyards is released from any and all liability if anyone other than a Backyards to Barnyards entity (family, friends, housekeepers, landscapers, etc) has access to your home during service. Backyards to Barnyards has a zero liability policy on job sharing. 
-The petsitter, Backyards to Barnyards, agrees to provide agreed upon services in a manner that is trustworthy, caring and dependable.  In consideration of the services as an express condition thereof, the client expressly relinquishes any and all claims against the company and its employees, except those arising from negligence. 
-I furthermore agree and understand that the petsitter will be in possession of a key, for which I will provide the petsitter with TWO copies of. If pet owner fails to provide TWO copies of key at meet and greet, business owner will make ONE copy at charge to pet owner of $5 per key. Business owner agrees to maintain no more than two copies per key at any given time, and will only make copies as necessary. If a key is lost, client will be noticed and another copy will be made at no charge to client.  The pet sitter agrees to place identifying codes on my keys, and they will not be marked with my name, address, or pets name. When my keys are not in use, they will be stored in a secure location by the petsitter.
-I understand that if I decide at any time I prefer to have my key returned at the last visit of my service, I will leave a note on the first day of service. This note will include the message "Pet Sitter- Leave Key on "the date and time of the last scheduled visit" and instructions on how to secure my home while leaving the key. I understand that the sitter will not be able to access my home again after the petsitter has left the key, including in case of emergencies or in delay of my return. Keys will be left at last visit in location agreed upon by sitter and client for all clients who do not wish to leave keys on file. If sitter fails to leave key at location agreed upon, there will be no charge to client to return key. All clients who request returns on their keys at any time other than last visit will be subjected to an $8 mailing fee. Last minute or emergency service cannot be provided for clients who do not leave keys on file. Backyards to Barnyards accepts no responsibility for keys sent via mail, lost in the mail, left under mats, in between doors, or any other means. Backyards to Barnyards will return your key, in person, for a fee of $10 plus regular travel fee. 
-Client agrees to discuss any concerns with the petsitter, Backyards to Barnyards, within 24 hours of return after service.
This agreement is valid from the date signed, and replaces any prior Legal Considerations agreements.  Client agrees to any future term changes relayed verbally to the client, mailed or emailed in writing to the client, or posted on our website where there is always an up to date version of our policy.
-The owner states that he/she as read this agreement in its entirety and fully understands and accepts its terms and conditions.
